1. Agreement to Terms

By accessing or using OALO ("the Service"), operated by OALO AI ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

OALO is an AI-powered platform that enables users to build, deploy, and host web and mobile applications. The Service includes an application builder, real-time data synchronization, managed hosting, payment integrations, app store publishing tools, custom domain support, and related infrastructure. We provide the tools — you build the product.

3. Eligibility

You must be at least 18 years old and capable of forming a binding contract to use the Service. By using OALO, you represent that you meet these requirements.

4. Account Registration

You must provide a valid email address to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

You agree to notify us immediately of any unauthorized access to your account.

5. Subscription and Payments

Access to the Service requires a paid subscription. Pricing is published on our website and may change with 30 days' notice. Subscriptions are billed monthly through Stripe.

Usage-based services, including AI features (code generation, chat, and assistance), messaging (such as WhatsApp and SMS), and media generation, are billed by usage at the rates shown in your dashboard.

To pay for usage-based services we maintain a prepaid usage balance on your account. When your balance falls below a set threshold, we automatically charge the payment method on file, including the card you provided for your subscription, to replenish it by a set amount. You can view your balance and change or turn off automatic top-ups at any time from your dashboard. If automatic top-ups are off or a charge cannot be completed, usage-based services may be paused until your balance is restored.

All fees are non-refundable except where required by law. Cancellation takes effect at the end of the current billing period.

6. Your Content and Data

You retain all ownership rights to the applications, code, data, and content you create using the Service ("Your Content"). We do not claim any intellectual property rights over Your Content.

You grant us a limited license to host, store, transmit, and display Your Content solely to provide the Service to you.

You are responsible for ensuring Your Content does not violate any third-party rights or applicable laws.

7. AI-Generated Output

The Service uses AI models to assist with code generation, design, and application building. AI-generated output is provided "as-is". You are solely responsible for reviewing, testing, and validating any AI-generated code or content before deploying it.

We do not guarantee the accuracy, security, or fitness for purpose of AI-generated output.

8. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable law, regulation, or third-party rights
  • Build or distribute malware, phishing sites, or fraudulent applications
  • Engage in unauthorized data collection or surveillance
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Resell, redistribute, or sublicense the Service without written permission
  • Use the Service in any manner that could damage, disable, or impair our infrastructure
  • Deploy applications that contain illegal content or promote violence

We reserve the right to suspend or terminate accounts that violate these terms without prior notice.

9. Hosting and Uptime

We provide managed hosting for applications built on the Service. While we strive for high availability, we do not guarantee uninterrupted service. Scheduled maintenance windows will be communicated in advance when possible.

We are not liable for downtime caused by factors beyond our reasonable control, including third-party infrastructure failures, DNS propagation, or force majeure events.

10. Custom Domains

When you connect a custom domain to your application, you are responsible for configuring DNS records as instructed. SSL certificates are provisioned automatically via AWS Certificate Manager. We are not responsible for domain registration, renewal, or DNS issues outside our control.

11. Third-Party Services

The Service integrates with third-party providers including Stripe (payments), AWS (infrastructure), Apple App Store Connect, and Google Play. Your use of these integrations is subject to their respective terms. We are not responsible for the availability or conduct of third-party services.

12. Intellectual Property

The Service, including its software, design, documentation, and branding, is owned by OALO AI and protected by intellectual property laws. Nothing in these terms grants you rights to our trademarks, logos, or proprietary technology beyond what is necessary to use the Service.

13. Limitation of Liability

To the maximum extent permitted by law, OALO AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of revenue, data, profits, or business opportunities, arising from your use of the Service.

Our total liability for any claim arising from the Service is limited to the amount you paid us in the 12 months preceding the claim.

14. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

15. Termination

You may cancel your subscription at any time from your dashboard. Upon cancellation, your access continues until the end of the current billing period. After that, your hosted applications will be taken offline and your data will be retained for 30 days before deletion.

We may suspend or terminate your account immediately for violations of these terms or if required by law.

16. Changes to Terms

We may update these terms from time to time. Material changes will be communicated via email or through the Service. Continued use after changes take effect constitutes acceptance of the updated terms.

17. Governing Law

These terms are governed by and construed in accordance with applicable law. Any disputes arising from these terms or the Service shall be resolved through binding arbitration, except where prohibited by law.
